To meet the new SBO criteria you must be the majority owner of a eligible registered business located in the ACT and you are claiming Matrix points in the Small Business Owner category. 

The following business types are not eligible: sub tenancy, ride-share, taxi, delivery, courier services or an on-sold business previously used to qualify for ACT nomination.

Your nominated occupation does not have to be on the ACT Critical Skills List.

Following criteria are given under the new SBO category:

Are you the majority owner of a registered business located and actively operating in the ACT? You must meet the following minimum criteria:

  •  Your business must have a minimum turnover of $200,000 per annum (or pro-rata).
  •  Your business must be profitable.
  •  Your business must be paying you the following salary immediately before date of Matrix submission:
  • 190 nomination: at least $26,000 for six months.
  • 491 nomination: at least $13,000 for three months.
  • You must employ at least one Australian citizen, permanent resident or New Zealand citizen for at least 13 weeks (minimum 20 hrs pw).
  • You may employ one or more employees. The employment does not have to be continuous.
  • The employment must be in accordance with Australian legislation.
  • You MUST provide a statutory declaration confirming the employment and citizenship details for each employee.
  • 20 Matrix Points – Your business has actively traded in Canberra for at least twelve months from the date established or purchased. 
  • 10 Matrix Points – Your business has actively traded in Canberra for at least six months from the date established or purchased.

The ACT government further provided the following update:

  • 457 / 482 pathway: The minimum invitation ranking for a 457 / 482 visa holder is now 65 points.
  • Spouse can not claim overseas tertiary qualifications 5 points. Only a tertiary qualification from an Australian institution for full time continous study are accepted with minimum competent English. 5 Matrix points can be claimed.
  • Business owner and start up options has been removed from Assets in Canberra.
  • Strict enforcement of a one ACT Nomination place.
  • Statutory declaration on employed in a genuine position is mandatory. 
  • 2021-2022 year nomination place for 491 is 1400 and 190 600. The ACT governments already has 1500 eligible 491 Matrix with 65 plus points in the queue, and over 700 190 Matrix in the queue with 85 points plus, though the majority of there are accountants.
  • Invitations will still be issued weekly at this stage, normally on a Friday morning.  On average, 165 nominations each month, pro rata against the 2000 allocation
